Doręczenie decyzji uważa się powszechnie w doktrynie i orzecznictwie za warunek uzyskania prawnego bytu przez decyzję, „wejścia do obrotu prawnego”. Decyzja niedoręczona traktowana jest jako akt pozorny („nieakt”), który nie leży w sferze prawa i nie wywołuje żadnych skutków prawnych. Nie może być przedmiotem odwołania ani wniosku o rektyfikację (uzupełnienie lub sprostowanie). Nie zawsze jednak doręczenie decyzji jest warunkiem jej obowiązywania. Kodeks postępowania administracyjnego dopuszcza w określonych sytuacjach możliwość publicznego ogłaszania o decyzjach, a ustawy szczególne – możliwość zawiadamiania o określonych decyzjach jej adresatów za pomocą środków komunikacji. W sytuacji wielości stron powstaje pytanie, czy dla uzyskania przez decyzję bytu prawnego niezbędne jest jej doręczenie wszystkim stronom, czy wystarczy doręczenie choćby jednej z nich. Odrębnymi zagadnieniami są kwestia konieczności doręczania stronom załączników do decyzji i ocena prawna sytuacji, w której nawet oryginał decyzji nie jest zaopatrzony w wymagany załącznik.
