Otterbourg on behalf of the Commercial Finance Association, along with the Loan Syndication and Trading Association, filed an amicus brief with the New York Court of Appeals to appeal a decision of the New York appellate division court in American Remanufacturing that dismissed a fraud claim by DDJ and other lenders to American Remanufacturing against the sponsors owing equity in the borrower and the accoutants. The filers of the appeal whether the accountants are protected from liability based on certain GAAP rules as to subsequent events after a year end opinion as to financial statements is provided by such accountants.
