พรบ.อุ้มหาย 2565 คืออะไร พรบ.อุ้มหาย มีชื่อเต็มว่า พรบ.ป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย พ.ศ.2565 ประกาศลงราชกิจจานุเบกษาในวันที่ 25 ตุลาคม 2565 และใช้มีผลบังคับใช้ใน 120 วัน ซึ่ง พรบ.นี้ มีวัตถุประสงค์ในการป้องกันมิให้เจ้าหน้าที่รัฐ ละเมิดสิทธิมนุษยชนตลอดจนป้องกันการทรมานและการปฏิบัติหรือลงโทษอื่นที่โหดร้าย ไร้มนุษยธรรม ย่ำยีศักดิ์ศรีความเป็นมนุษย์ ใช้บังคับเมื่อไร          หลังจากที่ พรบ.ดังกล่าวมีผลบังคับใช้ ทางกฎหมายเมื่อวันที่ 22 กุมภาพันธ์ 2566 หลังจากประกาศราชกิจจานุเบกษา 120 วัน แต่ทว่าการบังคับใช้นั้นยังไม่สามารถกระทำได้ เนื่องจากขาดงบประมาณและวัสดุอุปกรณ์ รวมถึงความรู้ความเข้าใจต่อข้อกฎหมายของผู้ปฏิบัติ ต่อมาวันที่ 18 พฤษภาคม 2566 ศาลรัฐธรรมนูญได้มีมติว่า พรก.เลื่อนบังคับใช้นั้นขัดต่อรัฐธรรมนูญ และใช้ พรบ.ดังกล่าวมีผลมาตั้งแต่ต้นซึ่งนั่นก็คือ วันที่ 22 ก.พ. 66 นั่นเอง ใครได้ประโยชน์      จะว่ากันแล้วตั้งแต่ พรบ.นี้ออกมาบังคับใช้ […]
