近年来，南海局势发展平稳，中国与东盟国家积极推动本地区海洋合作。作为本地区海洋合作中一个非常重要的方面，南海渔业管理愈益引发本地区及域外各国学者关注，但学者所提建议有些并不切合实际。有关南海渔业管理合作的多数建议之所以难以施行，乃在于其不易划出令争端相关各方皆满意的地理区域以适用“实际性的临时安排”[1] ——该“临时安排”应对各方在南海的领土主权主张及有关专属经济区划界的最终协议皆不会产生影响。本文主要关注如何解决上述合作困境，尤其是有关南海渔业管理合作的推进路径（也可包括相关海洋环保或生物多样性保护问题）。 一、为维护南海生态系统健康，愈益需要加强渔业管理合作 在可预见的近期未来，南海的领土主权与海洋划界争端不太可能获得最终解决，各当事国的政策仍会受其国内“民族主义情绪”和党派政治斗争影响。照此发展，若有关合作倡议牵涉领土主权或主权权利归属等敏感议题，势必很难促使当事国政府软化其立场或推进“实际性的临时安排”。虽然南海沿岸国有遵照《联合国海洋法公约》第123条规定进行“互相合作”之法律义务，但是争端相关方已习惯于南海缺乏合作机制以确定主张重叠区域内管辖权和执法权临时安排的境况。这对地区海洋环境和渔业可持续发展产生了严重影响，有关研究显示，南海鱼类资源过去30年来已减少了三分之一，而且按往常情形发展到2045年该区域海洋物种将损失数量多达59%。
